Terms of Service

Use of This Site
This site is for informational purposes. You may not use it to distribute spam, conduct illegal activity, or misrepresent your identity or business.
Services
newmyer.co designs, builds, and manages websites for small businesses. Services are described on the Pricing page. Final scope, deliverables, and pricing are confirmed in writing in a signed Client Service Agreement before work begins. Prices listed on this site are estimates and may change based on actual project scope.
Website Platform and Hosting
Client websites are built and hosted on third-party platforms, including Duda. Monthly plans cover management of that hosting on the client's behalf. newmyer.co does not control and is not responsible for platform outages, service interruptions, feature changes, or price changes made by third-party providers. Reasonable effort will be made to notify clients of changes that affect their site.
Domain Names
Clients may bring a domain they already own, in which case newmyer.co will connect it to the site at no additional charge. If a client does not have a domain, newmyer.co will research and recommend one. The specific domain name and its exact cost are confirmed with the client in writing before any purchase is made.
Domains are billed to the client at cost with no markup and are due before registration. Standard domains typically run $10 to $20 per year, though premium and specialty domains can cost significantly more. Any domain cost quoted in an estimate or on the pricing page is an approximation until the specific domain is selected and confirmed.
Domains are registered in the client's name wherever the registrar allows it. The client owns their domain regardless of who manages it. While an active monthly plan is in place, newmyer.co manages renewal on the client's behalf and bills the renewal at cost. If the monthly plan is cancelled or lapses, responsibility for renewal returns to the client, and the domain will be transferred to a registrar account the client controls on request. newmyer.co is not responsible for a domain that expires after that responsibility has transferred.
Site Ownership and Transfer
Clients own their website content, including copy, images, and business information they provide or that is created for them. Upon request, or upon cancellation, a site will be transferred to a hosting account the client controls using the platform's transfer process. After transfer, newmyer.co is no longer responsible for hosting, maintenance, or support of the site.
Domain names are addressed in the Domain Names section above. Client-owned domains transfer with the site.
Payment and Cancellation
Website build fees are one-time, flat, and agreed in writing before work begins. Monthly plans are billed month to month with no long-term contract. Clients may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are not refunded.
If a balance goes unpaid, the following applies:
- After 14 days, minor edits and other plan services pause. The site stays online.
- After 60 days, the site comes offline while the balance is being resolved. Nothing is lost, and it can be restored as soon as the balance is settled.
- After 120 days, the site is archived and removed from active hosting, and the working relationship is considered ended. Once any outstanding fees are paid, full transfer of the site and domain is made to the client.
Written notice will be sent before a site comes offline, and again before it is archived. At any point before then, once the balance is paid in full, the site can go back online or transfer to a hosting account the client controls, whichever they prefer.
Money gets tight sometimes, and slow seasons are real. If paying on time is going to be a problem, clients are expected to reach out. As long as there is clear communication, a workable solution can usually be found. The timeline above is meant for situations where communication stops.
Client Responsibilities
Clients agree to provide content, photos, business details, and account access needed to complete the work, and to respond to communications within a reasonable timeframe. Delays caused by missing information or approvals are not the responsibility of newmyer.co.
Clients confirm that any content they provide is theirs to use, or that they have permission to use it. Clients agree to indemnify newmyer.co against any claim arising from content they supplied, including copyright, trademark, and image rights claims.
Printed Materials
Design fees for printed materials cover design only. Printing, shipping, and mailing costs are billed to the client at cost or paid by the client directly to the printer. newmyer.co is not responsible for print quality, production errors, or delivery delays caused by third-party printers.
Portfolio and Reference
newmyer.co may reference completed work, including screenshots and links, in a portfolio or promotional context. If a client prefers their work not be shown, they may request that in writing and it will be removed.
No Guarantee of Results
A website does not guarantee specific business outcomes. Search rankings, traffic, and customer inquiries depend on industry, location, competition, search engine behavior, and other factors outside our control. Search engine and AI visibility setup improves the chance of being found; it does not guarantee placement.

Templates, underlying code structures, and reusable design components developed by newmyer.co remain the property of newmyer.co.
Limitation of Liability
newmyer.co is not liable for any indirect, incidental, or consequential damages arising from use of this site or services, including lost revenue, lost data, or business interruption. Total liability is limited to the fees paid in the most recent 30-day period.
Termination
Either party may end the working relationship at any time with written notice. newmyer.co reserves the right to decline or discontinue service, including for nonpayment or unreasonable conduct. Work completed and invoiced remains payable.
